Privacy Notice
1. Introduction

(a) Website Owner. TrueLeap Inc. (“we”, “us”, or “our”) is the owner of this website and related applications (“our Website” or “the Website”). We can be contacted by by phone at +1(832)392-8115 , or by e-mail at info@trueleap.io. This online privacy notice discloses our information practices for the use of the Website, including what type of personal information is collectedin order to subscribe to services, access contents etc., how the information is used, and with whom the information is shared. Note that TrueLeap may own other websites. Those other websites may be governed by privacy notices containing different information practices applicable to those sites.

(b) Web Users. Users of TrueLeap Website such as a student, parent, teacher, or administrative personnel of an educational institute who is authorized to access the Website (“a customer” or “customers”) or a potential customer of TrueLeap. Collectively or individually, we refer to these people as “you” or “your.”

(c) Web Site Visits. We collect certain information about you through your use of our Website. This includes, but is not limited to, the home server domain name, type of computer and web browser you use, what pages you accessed, information about your search requests, and the general geolocation (not the precise location) of your device. This information is used to solve technical problems and to calculate overall usage statistic.

(d) Web Site Transactions. In order to provide services and contents in a responsible manner and to meet your specific educational needs we will need certain personal information from you. For example, to process an order or provide a subscription, we need your name, postal address, e mail address, the user name and password you use to access the services and contents. At times, you might be prompted to enter financial information, such as credit card information, to purchase a product or service, such information is collected and processed by a third party who processes the payment. We (TrueLeap) do not collect, process, store, or retain your financial information. It is our policy to inform you of our information practice. Please refer to the next sections for what information we collect, how we collect, and how it is used. If you tell us that you
do not wish to have certain of all of your information used, we will make the best effort to respect your wish to the extent TrueLeap has control over your information. However, this might result in your inability to use our services.

2. Personal Information That May Be Collected

(a) Identifying Information. Please note, except for the information collected through your use of our Website, we do not collect your information directly from you. But rather, we collect your information through the local educational institute with whom we have a pre-existing business relationship to provide educational services, and with whom you are a member, such as as a student. Currently, our services are only available through such institutes. In order to provide you access to designated subscriber services and/or restricted areas within our Web site, and to prevent unauthorized access to your privacy, we will need to verify your identity with certain personal identifying information, which may include your name, postal address, e-mail address, user name, password, telephone number.

(b) Payment Information. If you are interested in any of our products or services, you might be required to pay for them. Currently, our products and services are only available through schools and education institutes. Your payment will be made to your respective school or institute. In the future, if a product or service is available directly to you, and you wish to obtain it directly from us, your payment information will be collected and processed by a third-party payment processing company we use. We (TrueLeap) will not collect, process, store, or retain your payment information.

(c) Additional Information. We might request additional information from you as we continue to develop and improve our products and services. We will only do so when it’s necessary. In that event, we will give you advance notice and, depending on the nature of the information, the opportunity to opt out of providing that information.

(d) Service Quality Monitoring. Some Web site transactions may require communication between you and us via phone calls. We will not contact you by telephone without your prior consent, except to confirm an order placed online and/or to inform you of the status of such an order. Please be aware that it is our practice to monitor, and in some cases record such calls for staff training or quality assurance purposes.

(e) Information from Children. We do not directly collect personal information from children under the age of 18. Our products and services are only available through schools and education institutes with whom you are a member. If you are under the age of 18, we obtain your information from your respective school or the education institute with whom you are a member in the same way as we collect information from an adult user. We rely on the educational institutions commitment guarding children’s privacy.

(f) Customer Change of Information. If you are a customers, you will have the ability to create a user account at our Website which is protected by username and password. You will be able to access and modify certain personal information within your user account. If your personal information has changed but the information is not modifiable within your user account, please e-mail the new information to us at info@trueleap.io. If you would like to review the personal information we have in our files, please e-mail your request to info@trueleap.io.

(g) Lost or Stolen Information. If your credit card and/or password is lost or stolen, you should promptly notify TrueLeap in order to enable TrueLeap to cancel the lost or stolen information and to update its records with an updated credit card and/or password.

(h) Chat Rooms, Forums and Bulletin Boards. If customer participates in an TrueLeap chat room, discussion forum, or posts messages to an TrueLeap bulletin board, customer should be aware that the information disclosed and shared will be broadly available to other persons, both inside of and/or outside TrueLeap, who have access to that chat room, forum or bulletin board. Some individual TrueLeap chat rooms, forums or bulletin boards have additional rules and conditions regarding participation. Also, a participant’s expressed opinion is his or her own and should not be considered as reflecting the opinion of TrueLeap.

(i) Links to Other Websites. A TrueLeap Web site may contain links to other websites. TrueLeap is not responsible for the privacy practices or the content of those other Web sites.

3. Uses Made of the Information

(a) Limited Uses Identified. Without customer’s prior consent, TrueLeap will not use your personal identifiable information for any purpose other than that for which it is submitted. TrueLeap uses personal identifiable information to reply to inquiries, handle complaints, provide operational notices and in program record-keeping. TrueLeap also processes billing and business requests related to TrueLeap Website participation.

(b) Marketing Uses. Unless customer marks an “x” on the opt-out option box herein provided, TrueLeap reserves the right to provide customer with information about TrueLeap’s Website, mobile applications, TrueLeap products and services, and related information in which customer has indicated an interest. The information you provide to the TrueLeap Web site may also be collected, used, analyzed and/or processed by TrueLeap, or selected third parties on TrueLeap’s behalf, for marketing and other business purposes. Before TrueLeap uses the information, however, TrueLeap will notify customers and offer customers the opportunity to opt-out if a customer wishes not to have personal identifying information used in this way.

(c) Stored Information Uses. TrueLeap stores and retains the information entered on the TrueLeap Website and mobile apps. This information is used to compile a customer’s subscription history in order to enable TrueLeap to recommend products, services, or special offers that would be of interest to a customer.

(d) Online Advertising. Some companies that help TrueLeap deliver interactive on-line advertising, such as banner ads, may collect and use information about TrueLeap’s customers to help TrueLeap better understand the types of advertising or promotions that are most appealing to TrueLeap’s customers. After it is collected the information is aggregated so it is not identifiable to a specific individual. If, however, customers would prefer that these companies not collect such information, please mark an “x” on the opt-out option box herein provided.

4. Disclosure of the Information

(a) Within Corporate Organization. TrueLeap is a multinational organization, with legal entities, business processes, management structures, and technical systems that cross borders. TrueLeap may share your personal information within the TrueLeap corporate organization, and may transfer the information to countries in the world where TrueLeap conducts business. Some countries may provide less legal protection for customer personal information. In such countries TrueLeap will still handle customer personal information in the manner described herein.

(b) Mergers and Acquisitions. Circumstances may arise where for business reasons, TrueLeap decides to sell, buy, merge or otherwise reorganize its businesses in the United States or some other country. Such a transaction may involve the disclosure of personal identifying information to prospective or actual purchasers, and/or receiving such information from sellers. It is TrueLeap’s practice to seek appropriate protection for information in these types of transactions.

(c) Agents. TrueLeap employs or engages other companies and individuals to perform business functions on behalf of TrueLeap. These persons are provided with personal identifying information required to perform their functions, but are prohibited by contract from using the information for other purposes. These persons engage in a variety of functions which include, but are not limited to, fulfilling orders, delivering services, removing repetitive information from customer lists, analyzing data, providing marketing assistance, processing credit card payments and providing customer services.

(d) Affiliated Businesses. TrueLeap works closely with affiliated businesses operating educational programs, providing services, or promoting services and products on each other’s Web sites. These businesses identify themselves to customers. Customer information related to a transaction with an affiliated business is shared with that affiliated business.

(e) Marketing Analysis by Third Parties. TrueLeap reserves the right to disclose to third parties personal information about customers for marketing analysis; however, any information disclosed will be in the form of aggregate data that does not describe or identify an individual customer.

(f) Disclosure to Governmental Authorities. TrueLeap releases personal identifying information when TrueLeap believes release is appropriate to comply with law, to enforce TrueLeap agreements, or to protect the rights, property or safety of TrueLeap customers. TrueLeap may also release such information in an exchange of information with other companies and/or organizations for the purposes of fraud protection and credit risk reduction.

5. Use of Computer Tracking Technologies

(a) No Tracking of Personal Information. TrueLeap’s Website(s) are not set up to track, collect or distribute personal information not entered by visitors. Our site logs do generate certain kinds of non-identifying site usage data, such as the number of hits and visits to our sites. This information is used for internal purposes by technical support staff to provide better services to the public and may also be provided to others, but, again, the statistics contain no personal information and cannot be used to gather such information.

(b) Use of Cookies. TrueLeap, or its third party vendors, collects non-identifiable and personal information through the use of various technologies, including “cookies.” A cookie is an alphanumeric identifier that a Web site can transfer to a customer’s hard drive through the customer’s browser. The cookie is then stored on the customer’s computer as an anonymous tag that identifies the customer’s computer, but not the customer. Cookies may be sent by TrueLeap or its third party vendors. Customer can set its browser to notify the customer before a cookie is received, giving an opportunity to decide whether to accept the cookie. Customers may also set its browser to turn off cookies; however, some Web sites may not then work properly.

(c) Use of Web Beacon Technologies. TrueLeap may also use Web beacon or other technologies to better tailor its Web site(s) to provide better customer service. If these technologies are in use, when a visitor accesses these pages of the Web site, a nonidentifiable notice of that visit is generated which may be processed by TrueLeap or by its suppliers. Web beacons usually work in conjunction with cookies. If customer does not want cookie information to be associated with customer’s visits to these pages, customer can set its browser to turn off cookies; however, Web beacon and other technologies will still detect visits to these pages, but the notices they generate cannot be associated with other non identifiable cookie information and are disregarded.

(d) Collection of Non-Identifiable Information. TrueLeap may collect non-identifiable information from user visits to the TrueLeap Web site(s) in order to provide better customer service. Examples of such collecting include: traffic analysis, such as tracking of the domains from which users visit, or tracking numbers of visitors; measuring visitor activity on TrueLeap Website(s); Web site and system administration; user analysis; and business decision making. Such information is sometimes known as “clickstream data.” TrueLeap or its contractors may use this data to analyze trends and statistics.

(e) Collection of Personal Information. TrueLeap collects personal identifying information from customers during a transaction. TrueLeap may extract some personally identifying information about that transaction in a non-identifiable format and combine it with other non-identifiable information, such as clickstream data. This information is used and analyzed only at an aggregate level (not at an individual level) to help TrueLeap understand trends and patterns. This information is not reviewed at an individual level.

6. Information Security

(a) Commitment to Online Security. TrueLeap works to protect the security of customer personal information during transmission by employing software which encrypts the information that customers and prospects input. TrueLeap’s practice is to reveal only the last four digits of a customer’s credit card numbers when confirming an order. During order processing the entire credit card number is revealed to the credit card company selected by the customer.

(b) No Liability for Acts of Third Parties. TrueLeap will exercise all reasonable efforts to safeguard the confidentiality of customer personal information. However, transmissions protected by industry standard security technology and implemented by human beings cannot be made absolutely secure. Consequently, TrueLeap shall not be liable for unauthorized disclosure of personal information due to no fault of TrueLeap including, but not limited to, errors in transmission and unauthorized acts of TrueLeap staff and third parties.

7. Privacy Policy Changes and Opt-Out Rights

(a) Changes to Privacy Policy. This privacy notice was last updated on 20th of September 2023. TrueLeap reserves the right to update its privacy policy statement at any time. A notice of any material change will be posted on the TrueLeap Web site on the web page containing the Privacy Notice for thirty (30) days prior to the implementation of such change.

(b) Opt-Out Right. Customer has the right at any time to cease permitting personal information to be collected, used or disclosed by TrueLeap and/or by any third parties with whom TrueLeap has shared and/or transferred such personal information. Right of cancellation may be exercised by contacting TrueLeap via e-mail at info@trueleap.io, telephone at +1 832 392 8115 or certified postal mail at the address TrueLeap Inc, Katy, TX 77494. After processing the cancellation, TrueLeap will delete customer or prospective customer’s personal information from its database.

8. Access Rights to Data

(a) Information Maintained by TRUELEAP. TrueLeap will provide customers with access to the following personally identifiable information: NAME, GRADE, TEACHER, AND CLASS GRADEBOOK for the limited purpose of viewing. To access this information, a customer will need to go to the “User Profile” page of this Web site or mobile app and enter the customer’s Username and Password. If a customer wishes to obtain a copy of particular information that customer provided to TrueLeap, send an e-mail request to info@trueleap.io.

(b) Corrections and Changes to Personal Information. If customer’s personal information changes, or if customer notes an error upon review of customer information that TrueLeap has on file, please promptly e-mail TrueLeap at info@trueleap.io and provide the new or correct information.

(c) Your California Privacy Rights. Beginning on January 1, 2005, California Civil Code Section 1798.83 permits customers of TrueLeap who are California residents to request certain information regarding TrueLeap’s disclosure of personal information for their direct marketing purposes. To make such a request, please write to: info@trueleap.io. Within 30 days of receiving such a request, TrueLeap will provide a list of the categories of personal information disclosed to third parties for third-party direct marketing purposes during the immediately preceding calendar year, along with the names and addresses of these third parties. This request may be made no more than once per calendar year. TrueLeap reserves its right not to respond to requests submitted other than to the address specified in this paragraph. California’s privacy laws require a company to provide notice to California users of their rights to receive information on to which entities their information was shared for marketing purposes.

9. Accountability

(a) Questions, Problems and Complaints. If you have a question about this policy statement, or a complaint about TrueLeap compliance with this privacy policy, you may contact TrueLeap by email at info@trueleap.io. If TrueLeap is unable to resolve your complaint to your reasonable satisfaction or if customer does not receive acknowledgment of an inquiry, customer may elect to proceed by contacting +1 832 392 8115.

(b) Terms of Use. If a customer chooses to subscribe to TrueLeap’s services, customer’s action is hereby deemed acceptance of TrueLeap practices described in this policy statement. Any dispute over privacy between customer and TrueLeap is subject to the provisions of this notice and to TrueLeap’s Terms of Use Agreement which is hereby incorporated herein and which can be read at TERM OF USE.
